1. Agreement to Terms

By accessing or using Coachismo ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you do not have permission to access the Service.

2. Description of Service

Coachismo provides advanced analysis of coaching session transcripts to help professional coaches improve their skills. The Service includes transcript upload, competency scoring, performance tracking, and personalized Cue Card generation.

3. Eligibility

You must be at least 18 years old to use this Service. By using Coachismo, you represent and warrant that you are at least 18 years of age.

4. Account Registration

• You must provide accurate and complete information when creating an account
• You are responsible for maintaining the security of your account credentials
• You must notify us immediately of any unauthorized use of your account
• One person or entity may not maintain multiple accounts

5. Subscriptions and Payment

5.1 Subscription Plans

Subscription plans and transcript limits will be posted on our pricing page and may be updated from time to time.

5.2 Billing Periods

• Monthly or Annual billing options available
• Subscriptions automatically renew unless cancelled

5.3 Payment Terms

• All payments are processed through Stripe
• No refunds for partial periods
• Unused monthly transcripts do not roll over to the next month

5.4 Price Changes

We reserve the right to modify prices with 30 days' notice to existing subscribers.

• Upload content that violates any confidentiality agreements
• Share or distribute other users' content

• Upload content containing protected health information (PHI) unless properly consented
• Circumvent usage limits through multiple accounts
• Use automated systems to access the Service

7. Content Ownership and License

7.1 Your Content

• You retain ownership of all transcripts you upload
• You grant us a license to process, analyze, and store your content for the purpose of providing the Service
• You are solely responsible for ensuring you have the right to upload all content

7.2 Our Content

• All analysis, feedback, and Cue Cards are provided as part of the Service
• You may use this output for your professional development
• You may not resell or redistribute our analysis as your own service

Your use of the Service is subject to our Privacy Policy. By using Coachismo, you consent to:

• Anonymization of transcripts before processing
• 5-year retention of your data

The Service, including its original content, features, and functionality, is owned by Coachismo and is protected by international copyright, trademark, and other intellectual property laws.

• Upon termination, your access will cease at the end of your current billing period
• We may suspend or terminate accounts for Terms violations immediately
• You may request data export before termination

• Modify or discontinue the Service at any time
• Add or remove features
• Change analysis methodologies
• Update our coaching competency framework
• Adjust transcript limits and pricing

15. Governing Law and Venue

These Terms are governed by the laws of California, without regard to its conflict of law provisions. Any disputes arising from or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in Alameda County, California, and you consent to personal jurisdiction in these courts.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Coachismo regarding the Service.
